We have an employee who works in FL but their permanent home address is in NY. Would this cause any issues during tax season? We have asked if they would like to update their address to their FL residence but they declined.
When you say they work in Florida are they actually living and working in Florida? Or are they just reporting to the Florida location from the comfort of their home in New York?
If the second scenario is true then they are correct in not changing to a Florida tax location.
Actually, for income tax, if they are domiciled in (or residents of) NY, all of their income will be taxable in NY anyway. FL does not have an income tax on wages. The only issue might be where the employer should be paying State Unemployment taxes.
