Last Paycheck (for a terminated EE)

Hello,

If an employee has 401k salary deferrals, FSA deductions...should these still be taken out of the EE's final pay?

  • Yes for everything if the pay is for time worked. If the pay is for accrued leave only, then no FSA, health insurance, or anything else that is calculated on X number of pay periods per year. Yes for 401k deduction unless your plan does not count paid leave as wages. (and I have never seen a plan do this)
