Hello, My Husband's employer did not withhold any state taxes last year. Is there anything they are liable for. This is in Colorado for 2020 tax year.
Jennifer since Colorado has a set percentage, your husband should have realized it with every check he received. If your employer was never notified by him, then they are not liable as they were unaware there was an issue. If, on the other hand, the company was notified by your husband (hopefully in writing) and he did that every time he noticed taxes were not being deducted, then the employer could be held liable for not making the required deduction.
I believe Colorado withholding follows the Federal W4 for determining withholding. Speak with the employer to determine the withholding certificates on file. See the following for additional information: Colorado does not have an equivalent state form to the federal W-4. ... An employer should use the information from the federal W-4 form to calculate the state wage withholding amounts. For employer information regarding Colorado withholding tax, see the Colorado Income Tax Withholding Worksheet For Employers (DR 1098). 3.
